The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of Cr. Case No. 5709/2023 arising out of FIR No. 31/2023 under Sections 279/337 of IPC registered at PS Naraina, Delhi and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

The petitioner has joined through VC while the respondent nos. 2 - 4 are present in Court and they have been identified by their respective counsels, as well as, by the Investigating Officer SI Brijesh Patel PS Naraina and SI Laxman PS Naraina.

The case of the prosecution is that the complainant was coming back from a wedding procession at around 1 O’clock at night near Nariana Flyover Loha Mandi, New Delhi when a car-Venue (Honda) DL9CAX2957 came at a very high speed and hit buggi of the complainant causing significant damage to the buggi and injury to the three complainants, which led to the registration of aforesaid FIR.

During the pendency of the proceedings, the parties were referred to Delhi Mediation Centre, Patiala House Court, New Delhi where the parties arrived at a settlement, the terms whereof have been reduced in writing in the form of settlement report dated 22.09.2025, which is annexed as Annexure-3 to the present petition.

The learned counsel for the petitioner submits that all the three injured have been paid the amount awarded by the learned Motor Accident Claim Tribunal (MACT) and in terms of the settlement the petitioner has further agreed to compensate the complainants/injured persons to the extent of Rs. 2,00,000/-.

A payment of Rs. 50,000/- was made at the time of recording of settlement and the balance amount of Rs.1,50,000/- has been paid today itself.

having received full and final settlement amount of Rs. 2,00,000/-. 11. On a query posed by the Court, the respondents affirm the factum of settlement and state that they do not wish to prosecute the criminal proceedings.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed.

Consequently, the petition is allowed and the FIR No. 31/2023 under Sections 279/337 of IPC registered at PS Naraina, Delhi alongwith all other proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms.
