By way of present petition, the petitioners seek quashing of FIR bearing no. 23/2020, registered at Police Station Economic Offences Wing, New Delhi for the commission of offences punishable under Sections 409/420/120-B of the Indian Penal Code, 1860 (hereafter „ IPC ‟).

The petitioners and the authorised representative of respondent no. 3 are present before this Court. They have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Economic Offences Wing, New Delhi.

Mr. Sarfaraz Khan, the learned counsel appearing on behalf of respondent no. 3 has filed his vakalatnama along with authorization of the respondent no. 3.

Briefly stated, facts of the present case are that on 01.09.2018, a Carrying & Forwarding (C&F) Agency Agreement was executed between Britannia Industries Ltd. (respondent no. 3) and M/s Sethi Agencies, covering operations at the Mundka depot of respondent no. 3 in New Delhi. It is stated that in the year 2018-2019, M/s Sethi Agencies was entrusted with the responsibility of handling warehousing, distribution, and forwarding of respondent no. 3‟s bakery products under the said Agreement. On 16.10.2019, certain dispute had arisen between the parties in lieu of which a criminal complaint was filed by respondent no. 3 and the said complaint was resulted in registration of the present FIR against the petitioners under the relevant sections.

It is stated that both the parties have amicably settled the present matter vide Settlement Deed dated 02.09.2025, entered between them. 6. On a query made by this Court, the authorised representative of respondent no. 3 who has been identified by the concerned IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. It is also stated by respondent no. 3 that the entire dispute has been amicably settled between the parties. Respondent no. 3 further states that she has no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 23/2020, registered at Police Station Economic Offences Wing, New Delhi for the commission of offences punishable under Sections 409/420/120-B of IPC and all consequential proceedings emanating therefrom are quashed, subject to payment of costs of Rs.10,000/- to be deposited by the petitioners with Delhi Police Martyrs‟ Fund, within a period of two weeks from date.

In view of the above, the present petition stands disposed of.
