1. The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter “BNSS”) [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter “CrPC”)] has been filed by the petitioner praying for quashing of FIR bearing no. 221/2024 registered at Police Station Roop Nagar for the offences punishable under Sections 118(1)/351 of the Bharatiya Nyaya Sanhita, 2023.

2. As per the FIR, the complainant-wife states that after matrimonial disputes she had shifted to her parental house. On 12.09.2024 at about 10:30 p.m., the husband (petitioner) allegedly came there in an intoxicated condition, abused her in filthy language, forcibly tried to take her away, and when her father and cousin (respondents) intervened, a quarrel occurred.

During that quarrel the husband allegedly attacked the complainant, her father and her cousin with a blade-type sharp weapon and caused bleeding injuries on the head/neck and other parts of their bodies, after which he fled leaving his slippers at the spot. Thus, the FIR came to be registered.

3. It is submitted that the petitioner and respondents no. 2 to 4 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. 4. Compromise deed dated 26.04.2025 is on record and has been annexed as Annexure P-3. Qua this deed, the respondents no. 2 to 4 have agreed to withdraw the case arising out of FIR No.221/2024 registered at Police Station Roop Nagar against the petitioner.

5. It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise.

6. Heard. Issue notice.

7. Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

8. Heard learned counsel for the parties and perused the record.

¶21

9. The petitioners are present before this Court and have been identified by their counsel and Investigating Officer, Police Station Roop Nagar. Respondents no. 2 to 4 are also present in the Court and have been identified by their counsel and the Investigating Officer.

10. On a query made by this Court, Respondents no. 2 to 4 have categorically stated that they have entered into compromise on their own free will and without any pressure. It is also stated that the entire dispute has

been amicably settled between the parties and they do not wish to pursue the matter any further as they are now moving towards a peaceful future and respondent no. 2 is now residing with the petitioner.

11. Keeping in view the fact that the matter stands amicably been settled between the petitioner and the respondents no. 2 to 4 amicably and without any pressure, no fruitful purpose would be served by keeping the matter pending.

12. It is, thus, in the interest of justice to quash the afore-mentioned FIR and the proceedings emanating therefrom. 13. Hence, in light of the judgment of the Hon‟ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303 , FIR bearing no. 221/2024 registered at Police Station Roop Nagar for the offences punishable under Sections 118(1)/351 of the Bharatiya Nyaya Sanhita, 2023, and consequent proceedings emanating therefrom, are quashed qua the present petitioner.
