Delhi High Court (Vikas Mahajan, J., 07.11.2025) allowed a petition under Section 528 BNSS, 2023 and quashed FIR No.27/2017 under Sections 498A/406/34 IPC, 1860 registered at Police Station Vijay Vihar, together with all consequential proceedings. The FIR arose out of a matrimonial dispute: the marriage of petitioner no.1 and respondent no.2 (solemnized 02.12.2014) broke down and the parties lived separately since 2016. During pendency they settled at the Delhi Mediation Centre, Rohini District Courts, recording a Settlement/Agreement dated 24.05.2023, under which petitioner no.1 paid Rs. 7.50 lacs to respondent no.2 towards full and final settlement of all her claims (streedhan, permanent alimony, dowry articles, maintenance past/present/future), and the parties obtained a mutual-consent divorce decree dated 23.04.2024. The State (through learned APP) and respondent no.2, present in court, raised no objection. Holding that continuation would serve no useful purpose and would only create further acrimony, the Court held quashing to be in the interest of justice.

The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.27/2017 under Sections 498A/406/34 IPC, 1860 registered at Police Station Vijay Vihar and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Issue notice. Ms. Richa Dhawan, learned APP for the State accepts notice. She submits that since the FIR is an outcome of a matrimonial dispute and the parties have arrived at a settlement, the State has no objection in case the FIR in question is quashed.

The brief facts of the case are that the marriage between the petitioner no.1 and respondent no. 2 was solemnized on 02.12.2014 according to Hindu Rites and Customs. Out of the said wedlock, one girl child namely, Megha was born on 25.11.2015, who is presently in the care and custody of respondent no.2/mother.

On account of temperamental issues certain disputes arose between the parties and they started living separately from each other since 2016. The dispute between the parties also led to the registration of the present FIR.

During the pendency of the proceedings, the parties were referred to Delhi Mediation Centre, Rohini District Courts, Delhi where they arrived at a settlement, the terms of which were reduced in writing in the form of Settlement/Agreement dated 24.05.2023, which is annexed as Annexure P-2 to the present petition.

In terms of the said settlement, the parties decided to dissolve their marriage by filing a petition for divorce by way of mutual consent. Accordingly, petitioner no.1 and respondent no.2 have obtained a decree of divorce dated 23.04.2024.

It is a term of the settlement between the parties that the petitioner no.1 shall pay a total sum of Rs. 7.50 lacs to the respondent no.2 towards full and final settlement of all her claims on account of streedhan, permanent alimony, dowry articles, maintenance (past, present and future) etc. The entire amount has already been paid by petitioner no.1 to respondent no.2 in the manner as mentioned in the settlement, receipt of which is also acknowledged by respondent no.2, who is present in Court.

Respondent no.2, on a query posed by the Court, states that she has no objection in case the FIR is quashed.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed.
