1. The present petitions have been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 482 of the Code of Criminal Procedure, 1973), challenging the orders dated 19.07.2025 passed by the learned Additional Sessions Judge-05, Central District, Tis Hazari Courts, Delhi, whereby the learned ASJ dismissed the revision petitions and upheld the orders dated 31.08.2023 passed by the learned Metropolitan Magistrate (NI Act), Digital Court-02, Central District, Tis Hazari Courts, Delhi, allowing the applications of the respondent/complainant under Section 143A of the Negotiable Instruments Act, 1881 (hereinafter “NI Act”).

2. It is also prayed by the learned counsel for the petitioner that she may be allowed to deposit 10% of the cheque amount as interim compensation to the complainant instead of 20% as per the order dated 31.08.2023 of learned Trial Court.

Today, learned counsel for the respondent appears on advance notice and submits that he has no objection if the present petitions are allowed to the extent to comply with the order passed by the learned Trial Court under Section 143A of the NI Act, and pay 10% of the cheque amount as compensation to the respondent/complainant, instead of 20% which was held by the learned Trial Court.

4. In view of the statement made by the learned counsel for the respondent/complainant, the present petitions are allowed.

7. It is made clear that nothing stated hereinabove, shall be construed as an opinion of the merits of the case, which shall be examined independently by the concerned Court.
