Inder Pal Singh & Ors. Vs the State & Ors.

The instant petition under Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the petitioners seeking quashing of FIR bearing no. 404/2016, registered at Police Station Karawal Nagar, Delhi for the offences punishable under Section 308/325/341/323/34 of the Indian Penal Code, 1860 (hereafter ‘IPC’ ).

Petitioners are present before this Court and have been identified by their learned counsel Mr. Vishnu Kant Pandey and the Investigating Officer (IO) from Police Station Karawal Nagar, District North-East, Delhi.

Brief facts of the present case are that the petitioners and the respondent no. 2 are residing in the same locality since last many years and are neighbours. It is stated that as per the complaint of the petitioner no. 3,

the FIR no. 146/2016, under Section 323/341/354/3081504/506/509/149 of IPC, P.S. Karawal Nagar, North-East District, Delhi has been also registered against the Respondent No.2, her family members and relatives/friends, the same is also pending for trial before the learned Additional Sessions Judge (Special Judge NDPS), District North-East, Karkardooma Court, Delhi for charge. It is stated that during the pendency of the present case, with the intervention of common friends, well-wishers and respectable persons of the locality, both the parties had amicably settled all their disputes vide Settlement/Compromise Agreement dated 06.10.2022.

On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will, volition and without any coercion, pressure or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties vide Settlement/Compromise Agreement dated 06.10.2022 and she has no objection, if the present FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the present proceedings, rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the above mentioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing no. 404/2016, registered at Police Station Karawal Nagar, North-East District, Delhi for the offences punishable under Section 308/325/341/323/34 of IPC and all consequential proceedings

emanating therefrom are quashed, subject to depositing cost of Rs. 1,000/each by the petitioners with Advocates Welfare Fund, Karkardooma Court within a period of seven days from date.

In view of the above, the present petition stands disposed of.
