Petitioners herein seek quashing of FIR No. 407/2018 dated 15.11.2018, for the alleged offences under Sections 323, 354, 506 and 34 of IPC lodged at Police Station K.N. Katju Marg, and all other consequential proceedings arising therefrom, on the basis of the compromise between the parties.

Dispute between the parties arose mainly from the matrimonial discord between Respondent no. 2 and her husband. The complainant alleged that her husband Aman (deceased), along with his father and two maternal uncles, physically assaulted her clothes also got torn in the scuffle. 3. amicably settled the matter vide Settlement Deed dated 29.04.2025 which is placed on record (Annexure C) . She further submits that an affidavit of no objection to the quashing, deposed by respondent no. 2, has also been placed on record.

Both the counsel for Respondent No. 2 and the learned APP for the State concur with the factum of the compromise arrived between the parties and convey their no objection to the quashing of the FIR. 5. In the aforesaid backdrop, I have heard learned counsel for the petitioners and respondent no. 2 as well as perused the material available on record.

The parties are present before the Court in person. Upon interaction, it appears that the underlying dispute, being private in nature, has indeed been amicably resolved. They further affirm in unison, of their own free will and without any coercion or duress that they do not wish to pursue the matter and consent to the quashing of the FIR in question.

Having interacted with the complainant and given that dispute appears to be entirely family matter not involving either public interest or societal interest, continuation of the criminal proceedings would serve no useful purpose and would rather amount to an abuse of the process of law. Not quashing the criminal proceedings would rather rekindle hostility, whereas quashing the same would promote cordiality and bonhomie.

Even on a plain reading, and in light of the candid statements of parties, it appears doubtful whether the essential ingredients of the offences invoked under the penal provisions are satisfied.

Taking a wholesome view and in order to let the parties to enjoy mutual cordiality and the family bonhomie, which will go long way to

establish peace rather than promote hostility in case further proceedings continue, this is a fit case to exercise inherent power under 528 of BNSS in quashing the FIR in question.

Therefore, the proceedings deserve to be quashed in the exercise of the inherent powers of the Court. Reference may be had to the judgement rendered in Gian Singh v. State of Punjab & Anr. [(2012) 10 SCC 303] in this context.

Accordingly, the petition is allowed. FIR No. 407/2018 dated 15.11.2018, for the alleged offences under Sections 323, 354, 508 and 34 of IPC lodged at Police Station K.N. Katju Marg, and all other consequential proceedings are hereby quashed.

Pending application(s), if any, also stand disposed of.
