By way of instant petition, the petitioner seeks quashing of FIR bearing no. 703/2022, registered at Police Station Bhalswa Dairy, Delhi for the commission of offence punishable under Section 307 of the Indian Penal

Issue notice. The learned APP accepts notice on behalf of the State.

The petitioner and respondent nos. 2 and 3 have appeared before this Court and have been identified by their counsels and the concerned Investigating Officer (IO) from Police Station Bhalswa Dairy, Delhi.

Briefly stated, facts of the present case are that the parties are the residents of same locality and have business relations. It is stated that on 19.08.2022, due to some differences and disputes, a quarrel took place between the parties based on which, the present FIR was registered against the petitioner, under the relevant sections. It is further stated that a cross-FIR bearing no. 704/2022 was also got registered against respondent nos. 2 and 3 at Police Station Bhalswa Dairy, Delhi for the commission of offence punishable under Section 324 of IPC.

It is stated that both the parties have amicably settled the present matter vide Settlement Deed dated 03.03.2025, entered between them. 8. On a query made by this Court, respondent nos. 2 and 3 who have been identified by the concerned IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated by respondent nos. 2 and 3 that the entire dispute has been amicably settled between the parties. In this light, respondent nos. 2 and 3 state that they have no objection, if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to

quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 703/2022, registered at Police Station Bhalswa Dairy, Delhi for the commission of offence punishable under Section 307 of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioner depositing cost of Rs. 10,000/- with the Advocates’ Welfare Fund, Rohini Courts, Delhi within a period of ten days from date and copy of the receipt be also filed with the Registry to show compliance of the order.

In view of the above, the present petition alongwith pending application, if any, stands disposed of.
