Petitioner herein seeks quashing of an FIR No. 392/2021 dated 17.08.2021 under Sections 354/354A/323/509/506 IPC, & Section 10 of the POCSO Act, 2012 registered at P.S. Jaitpur, Delhi, along with all the proceedings arising therefrom, on the basis of the compromise arrived between the parties.

The complainant alleges prolonged harassment, physical abuse, and sexual molestation by her step-father since childhood, including forced marriage and exploitation. She further alleges that her parents have

neglected her education and pressured her into immoral activities for earning money.

In the aforesaid backdrop, I have heard the counsel and interacted with the complainant who is present in Court.

Learned counsel for the petitioners submit that the parties are neighbours and, with the intervention of near and dears, they have amicably resolved their disputes vide MOU dated 07.07.2025 which is placed on record (Annexure-P-3) . He further submits that an affidavit of no objection to the quashing, deposed by respondent no. 2, has also been placed on record.

In response to a Court query, learned counsel for Respondent No. 2 and the learned Public Prosecutor for the State concur with the factum of the compromise dated 09.07.2025 between the parties. Learned counsel for complainant conveys his no objection to the quashing of the FIR.

Complainant is also present in Court and upon interaction with her, I am of the view, being a 27 year old lady she is well aware of her rights and is capable of taking her decisions on her own.

On a specific query as to whether she has entered into a settlement, she candidly submits that it is out of her own volition without duress or coercion. She submits that she did not realize the adverse consequences of the allegations leveled by her and which arose out of sheer emotional turmoil which she was suffering due to some other reasons and also the ill parenting meted out to her.

She submits that she is regretful that what was otherwise a routine family feud took an ugly turn. She does not wish to pursue any charges against her father, i.e., the petitioner herein and wants to focus on her career

as she is undertaking the competitive examinations and pendency of the criminal proceedings are impeding with her thought process to live peacefully.

Given that the dispute has been resolved, continuing with criminal proceedings may serve no useful purpose. It would be a drain on judicial resources and abuse of the process of law, especially when dispute does not involve any public interest or interest of the society at large. Continuation of the proceedings, on the other hand, would promote hostility between the parties and defeat the very purpose of the settlement.

Quashing the FIR would rather facilitate the parties to live with cordiality. Therefore, the proceedings deserve to be quashed in the exercise of the inherent powers of the Court. Reference may be had to the judgement rendered in Gian Singh v. State of Punjab & Anr. [(2012) 10 SCC 303] in this context.

Accordingly, exercising the inherent powers vested in this Court under Section 528 of BNSS, it is therefore deemed appropriate to quash the FIR arising from this matrimonial dispute.

Consequently, the instant petition is allowed. FIR No. 392/2021 dated 17.08.2021 under Sections 354/354A/323/509/506 IPC, & Section 10 of the POCSO Act, 2012 registered at P.S. Jaitpur, Delhi and the criminal proceedings arising there from are hereby quashed.

All pending application(s), if any, shall also stand disposed of.
