Recalling that its earlier order of 21.05.2025 in CRL.M.C 3597/2025 had noted the absence of prima facie reasons for the stay, and that the matter continued to be adjourned despite there being no reason for the stay, the Court requested the Sessions Court to dispose of the petition, listed for 20.09.2025, on that day itself or any other convenient date, and directed that reasons be assigned if it proposed to extend the stay. The petitioner challenges the order dated 15.05.2025, passed by the learned Court of Sessions thereby staying the operation of the order dated 13.05.2025, passed by the learned Chief Judicial Magistrate (‘ CJM ’), South District, Saket Courts, New Delhi.

The learned CJM by the order dated 13.05.2025 had directed the registration of FIR against the accused persons. 3. The petitioner had approached this Court on an earlier occasion in CRL.M.C 3597/2025 which was disposed of by this Court by order dated 21.05.2025. It was noted that the impugned order does not indicate prima facie reasons which led to granting of stay of the order passed by the learned CJM.

The present petition is, thereafter, filed being aggrieved that despite there being no reason for stay of the order passed by the learned CJM, the matter has been getting adjourned before the Court of Sessions.

Learned senior counsel for the petitioner states that the impugned order was passed at the instance of only one of the accused persons, however, the investigation has been stayed against all the accused persons.

It is informed that the matter is listed for consideration before the Court of Sessions on 20.09.2025.

In view of the above, the learned Court of Sessions is requested to dispose of the petition on the said day itself or any other convenient date. However, if it proposes to extend the stay of the operation of the order passed by the learned CJM, the reasons are directed to be assigned.

The petition is disposed of with the aforesaid observations.

Pending application also stands disposed of.
