Petitioner seeks quashing of FIR No. 250/2019 of PS Aman Vihar for offence under Section 323/354 IPC on the ground that the complainant de facto (respondent no.2) has compromised the disputes with him. The petitioner as well as respondent no.2 are present in person, identified by their respective counsel and IO/SI Pradeep. Learned APP on behalf of the State and respondent no.2 accept notice.

I have spoken with both the parties in Hindi. It is submitted by them that there was a property dispute, which has now been settled between them.

In terms with the settlement, the petitioner has handed over to respondent no.2, a demand draft of Rs. 2,00,000/- towards full and final settlement. On the other hand, respondent no.2 has handed over complete original documents of the property regarding which the dispute had arisen between them. It appears that earlier, there was a quarrel between the parties in the course whereof, the petitioner caught hold of chunni of respondent no.2 after which she extricated herself and fled. That led to the impugned FIR.

It is submitted by both parties that now there is no dispute between them and respondent no.2 states that she does not wish to pursue prosecution of petitioner.

Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push them through trial. Therefore, the petition is allowed and the case FIR No. 250/2019 of PS Aman Vihar for offence under Section 323/354 IPC and proceedings arising out of the same are quashed. Pending application stands disposed of.
