Petition under Section 482 of the Code of Criminal Procedure, 1973 read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioners for quashing of FIR No. 0217/2025 registered under Section 110 BNS at P.S. Bhalswa Dairy and the proceedings emanating therefrom in terms of the Settlement Deed dated 10.05.2025.

It is submitted that the fight took place between the Complainant and the Petitioners on the occasion of Holi when they were all consuming alcohol and throwing colours on each-other.

The Petitioners and the Respondent No. 2 are present in person in the Court and have been identified by their counsel and Investigating Officer.

terms thereof voluntarily and submit that the said Settlement has been arrived at between the parties, without any pressure and coercion and that they shall remain bound by the terms of the settlement.

The parties have submitted that all the disputes have been amicably settled vide Settlement Deed dated 10.05.2025 and thus, no fruitful purpose will be served in continuing with the FIR. 6. In terms of the settlement, the Complainant has already received the total settled amount of Rs.3,00,000/-, which is acknowledged by him. 7. In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to neighbours, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Considering the totality of circumstances and the nature of the dispute, which is essentially a neighborhood fight and the fact that they have settled the matter, the FIR No. 0217/2025 registered under Section 114 BNS at P.S. Bhalswa Dairy and all the consequential proceedings emanating therefrom are quashed.
