He appears to be an old and frail person.

We have put questions to him asking whether he is happy at his present place of residence. He, with the assistance of Mr. Rakesh Kumar (Respondent No.2 herein) and his wife, states that he is happily living with Mr. Rakesh Kumar and his wife at the moment and is satisfied with the same.

We, however, note that Sh. Rai Singh was able to answer the questions with the assistance of Mr. Ramesh Kumar and his wife.

The present petition is in the nature of habeus corpus , the primary prayer being

a) Issue Writ of Habeas Corpus Directing Respondent No. 1 to immediately produce Sh. Rai Singh, presently under the unlawful custody of Respondent No. 2, before this Hon’ble Court;

b) Upon production, be pleased to record the free wishes of Sh. Rai Singh and direct that he be set at liberty to reside wherever he chooses, free from illegal restraint and coercion of Respondent No. 2;

c) Direct Respondent No. 1 to ensure that Sh. Rai Singh is provided immediate access to appropriate medical treatment and care as required for his condition;

In view of reply of Sh. Rai Singh, we see no reason to pass any further order. Learned counsel for petitioner also seeks to withdraw the same with liberty to take any other action, as permissible under law.

The petition is disposed of accordingly.

Liberty, as prayed for, is granted.

All pending applications also stands disposed of in aforesaid terms.
