This is a fresh petition filed under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagarik Sanhita, 2023, for issuance of Writ in the nature of Habeas Corpus/Mandamus against the respondent Nos.1 and 2, seeking the following reliefs: -

i. Issuance of Writ of Habeas Corpus, thereby directing the Respondent No. 2 to produce Smt. Meenu (the wife of the Petitioner) before this Court, who is illegally confined by her family members, and after hearing her, Smt. Meenu, be allowed to go wherever she would like to go;

ii. Issuance of Writ of Mandamus, thereby directing the respondents to take appropriate

steps for the protection of the wife from her family members;

iii. Issuance of Writ of Mandamus, thereby directing the respondents to investigate and take action, based on the complaints filed by the petitioner, regarding illegal confinement and threats made by the family of Smt. Meenu;

The alleged detenue namely, Smt. Meenu, is present in-person and submits that she does not want to go with petitioner and that she is living happily with her parents. She also submits that no marriage has ever taken place between her and petitioner at any point of time.

In view of the aforesaid, learned counsel for the petitioner, on instructions, seeks to withdraw the present petition, with liberty to file appropriate petition before the appropriate forum, in accordance with law.

Permission and liberty, as prayed for, is granted.

Accordingly, the present petition is dismissed as withdrawn.
