By way of the present petition, the petitioners seek quashing of FIR bearing no. 191/2023, registered at Police Station Prashant Vihar, Delhi for the offences punishable under Sections 289/337 of the Indian Penal Code, 1860 (hereafter ‘ IPC ’).

The petitioner and respondent no. 2 have appeared before this Court through video-conferencing. They have been identified by their counsel and

concerned Investigating Officer (IO) from Police Station Prashant Vihar, Delhi.

Briefly stated, facts of the present case are that on 02.05.2023, when the petitioner was conversating with the guard along with his leashed dog, respondent no. 2 had approached the guard and the dog had grabbed the right elbow of respondent no. 2. On the same day, based on the aforesaid event, the present FIR was registered under the aforesaid sections.

It is stated that both the parties have amicably settled the present matter. Respondent No. 2 appearing through video conferencing states that since the petitioner has tendered an apology, he does not want to pursue the present FIR. The statements of the parties to the said effect have been recorded by the learned Joint Registrar (Judicial) on 22.04.2025.

On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. Respondent no. 2 further states that he has no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 191/2023, registered at Police Station Prashant Vihar, Delhi for the offences punishable under Sections 289/337 of IPC and all consequential proceedings emanating therefrom are quashed.
