By way of the present petition, the petitioner is seeking quashing of FIR bearing no. 0150/2025, registered at Police Station Malviya Nagar, District South, New Delhi for the commission of offences punishable under Sections 110/324(4)/126(2)/3(5) of the Bhartiyay Nyaya Sanhita, 2023 (hereafter ‘BNS’ ).

The petitioners and respondent no. 2 are appeared before this Court.

They have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Malviya Nagar, Delhi.

Briefly stated, the facts of the present case are that on 26.02.2025, at about 04:30 PM, on the issue of car parking by the respondent no.2, a misunderstanding has arisen between the petitioner and respondent no.2 and their known persons, resulting in a physical altercation and both the parties sustain injuries. On the complaint of respondent no. 2, the present FIR was registered at P.S. Malviya Nagar, Delhi under the relevant sections of law. It is stated that during the pendency of the present case, both the parties have amicably settled their disputes vide Memorandum of Understanding (MoU) dated 18.03.2025.

On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties. Respondent no. 2 further states that he has no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

consequential proceedings emanating therefrom are quashed, subject to petitioner depositing a cost of Rs. 10,000/- with the Advocates Welfare Fund, Delhi High Court within a period of two weeks from date.
