The present petition is filed seeking quashing of FIR No.93/2025 dated 15.02.2025, registered at Police Station Bhajan Pura, for offences under Sections 498A/406/34 of the Indian Penal Code, 1860 (‘ IPC ’) and Sections 3/4 of the Dowry Prohibition Act, 1961.

The learned counsel for the petitioners submits that the petitioners are the family members of the husband of the complainant and they have been unnecessarily implicated in the present case.

It is pertinent to note that the FIR was registered recently on 15.02.2025.

At the outset, the learned Standing Counsel for the State, on instructions, states that the investigation could not be completed since the husband of the complainant is not joining the same. He states that the complainant’s husband is residing in Canada. He submits that although the petitioners had joined the investigation, however, no final report could be prepared due to the non-cooperation of the complainant’s husband. He submits that even otherwise, at this stage, no coercive steps are proposed against the petitioners and this Court ought not interfere at this stage when the investigation is yet to be completed.

He further states that once the investigation is completed, there is always a possibility that the petitioners may not be found to be involved and an appropriate report can be filed at that stage. 8. Considering the above, this Court does not consider it apposite to entertain the present petition at this stage. As pointed out, the investigation is at a nascent stage and the same could not be completed due to the complainant’s husband not joining the same, as he is residing in Canada.

The present petition is, therefore, disposed of with liberty to the petitioners to approach the Court in case any grievance remains in the future.
