to direct Respondent No. 1 to provide adequate protection to the Petitioner from the hands of Respondent Nos. 2 and 3.

The Petitioner, a senior citizen, alleges that she is continuously harassed by Respondent Nos. 2 & 3, who are her son and daughter-in-law. It is alleged that the deceased husband of the Petitioner had already disowned Respondent Nos. 2 & 3, from all movable and immovable assets, by publishing a public notice. Ever since, Respondent No. 2 & 3 have been harassing her all the more and have even attempted to harm the Petitioner. To this effect, a written representation has been submitted with Respondent No.1 on 24^th February, 2024.

It is also pointed out that at the instance of husband of Petitioner (late Mr. Akbar Ali), this Court vide order dated 11^th March, 2024 in W.P.(CRL.) 811/2024 had directed Respondent No. 1 to provide adequate protection as and when required. The order is reproduced hereinunder:

“1. This petition has been filed under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973, for issuance of direction to the respondent nos. 1 and 2 to provide adequate protection to the petitioner from respondent nos. 3 and4.

2. The learned counsel for the petitioner submits that the respondent nos.1 and 2 have already shared the numbers of the concerned police officers with the understanding that the petitioner shall be provided adequate protection as and when required. He submits that with the above, the present petition stands satisfied.

3. Accordingly, the petition is disposed of.”

That said, Counsel for the Petitioner acknowledges that after filing of the instant petition, the Police Officers from the concerned Police Station have indeed met the Petitioner and have shared relevant contact numbers and assured police assistance to the Petitioner.

At this juncture, it must be clarified that the Court has not commented on the veracity of the allegations made by the Petitioner, nonetheless, since the Petitioner is a senior citizen and apprehends threat from her own family members, without going into merits of the allegations, the present petition is disposed of with a direction to Respondent No. 1 to share numbers of the concerned police officers and provided adequate protection to the Petitioner if and when required.
