State (Govt. of NCT of Delhi): Petition under Article 226 of the Constitution read with Section 528 of the BNSS, 2023 and Section 482 of the Cr.P.C., 1973 sought a further four-week extension of parole in FIR No. 859/2004, P.S. Sangam Vihar, Delhi (Sections 302/201/34 IPC and Section 25 Arms Act, 1959), on the ground that the Petitioner and his wife were blessed with a baby boy on 03.11.2024. This is a petition under Article 226 0f the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) seeking extension of parole for a period of four (4) weeks in FIR No. 859/2004 registered under Sections 302/201/34 of the Indian Penal Code (‘IPC’) and under Section 25 of the Arms Act, 1959 at P.S. Sangam Vihar, Delhi.

Learned counsel for the Petitioner states that the Petitioner and his wife have been blessed with a baby boy on 03.11.2024. He states that vide Order dated 14.11.2024 passed by this Court in WP(CRL) 3580/2024 titled Aas Mohd. V. State (Govt. of NCT of Delhi) , the Petitioner was granted

parole for a period four (4) weeks. And, in pursuance to the aforenoted Order dated 14.11.2024, the Petitioner was enlarged on parole on 19.11.2024.

2.1. He states that the period of the parole of the Petitioner was extended by further period of four (4) weeks vide Order dated 23.12.2024 passed in in WP(CRL) 3926/2024 titled Aas Mohd. V. State (Govt. of NCT of Delhi) and the extended period of Petitioner’s parole was set to expire on 20.01.2025.

2.2. He states that thereafter, once again the Petitioner’s parole was extended till 22.01.2025 by this Court in these proceeding vide order dated 17.01.2025.

Learned Standing Counsel for the State submits that the status report dated 20.01.2025 states that the medical documents filed by the Petitioner have been found to be genuine. He states that, however, considering the fact that the Petitioner has been on parole since 19.11.2024, no grounds are made out for grant of further parole to the Petitioner.

This Court has considered the submissions of the parties.

Keeping in view the status report, the Petitioner’s parole is extended by a period of two (2) weeks from today on the same terms and conditions, as set out in Order dated 14.11.2024 passed by this Court in WP(CRL) 3580/2024.

With the aforesaid directions, the petition stands disposed of

A copy of this Order be sent to the Jail Superintendent for information and necessary compliance.
