Petition under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (“BNSS”) has been filed on behalf of the Petitioners for quashing of FIR No.0029/2013 under Sections 420/406/34 IPC, registered at PS: Darya Ganj and all consequential proceedings emanating therefrom, in terms of MoU/ Settlement Deed dated 31.05.2022.

6. Petitioner No.1 and Respondent Nos.2 & 3 were partners in partnership firm namely M/s Sonal Offset Press (SOP) and are also related.

There were some disputes between them, which arose in regard to the functioning of the partnership firm, which have been resolved. For which, arbitration was resorted and now finally the matter has been settled in terms of MoU/ Settlement Deed dated 31.05.2022.

Learned counsel for the parties submit that in terms of MoU/ Settlement Deed dated 31.05.2022, FIR may be No.0029/2013 under Sections 420/406/34 IPC, registered at PS: Darya Ganj may be quashed. 8. It is further submitted that Rs.81,00,000/- had been deposited by the Petitioners, which may be returned to Petitioner No.1 and Respondent Nos.2 and 3 in proportionate as stated in MoU/ Settlement Deed dated 31.05.2022 along with proportionate interest, which may have accrued thereon. 9. The Petitioners and Respondent No. 2 are present before this Court in person and have been identified by their Counsel and Investigating Officer concerned.

10. It is submitted that the Petitioners and Respondent No. 2 have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

11. The parties have endorsed the MoU/ Settlement Deed dated 31.05.2022 and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Settlement.

12. The parties are related as family and apparently had some dispute in regard to functioning of partnership firm. They have voluntarily agreed to withdraw the criminal case.

13. In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also

the fact that the present matter is related to family members, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

In terms of the MoU/Settlement Deed dated 31.05.2022, FIR No.0029/2013 under Sections 420/406/34 IPC, registered at PS: Darya Ganj and all consequential proceedings emanating therefrom and all consequential proceedings emanating therefrom are hereby quashed. 15. Petition along with pending Application is accordingly disposed of
