The present petition has been filed under Section 528 of BNSS, 2023 seeking quashing of FIR No. 17/2024 under Sections 498A/406/34 IPC registered at Police Station Paschim Vihar, New Delhi and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Issue notice. The learned APP appearing on behalf of the State accepts notice. Likewise, learned counsel appearing for the respondent no. 2 also accepts notice.

matrimonial dispute and the parties have arrived at a settlement, the State has no objection in case the FIR in question is quashed.

The statement of the respondent no.2 has already been recorded by the learned Joint Registrar on 13.02.2025, which is on record.

The petitioner no.1 (former husband) along with petitioner nos. 2 to 4 who are mother, father and sister of petitioner no. 1, as well as, respondent no.2 are present in Court and they have been identified by the learned counsel appearing for the parties as also by the Investigating Officer SI Harish, Police Station Paschim Vihar, New Delhi.

The respondent no.2, on a query posed by the Court, affirms the factum of settlement and states that she has no objection in case the FIR is quashed. She also acknowledges the receipt of full and final settlement amount of Rs.16,50,000/-.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed.

Consequently, the petition is allowed and the FIR No. 17/2024 under Sections 498A/406/34 IPC registered at Police Station Paschim Vihar, New Delhi alongwith all other proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms.
