The present petition under Section 11 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: -

“A. The Respondent/Contemnor be punished with simple imprisonment for a term of six months and/or fine of Rs. 2,000/for the contempt committed under Section 11 And 12 of the Contempt of Courts Act, 1971 for willfully breaching and disobeying the undertaking given vide conciliated agreement dated 19.10.2022 in mediation petition no. 360/22 of Hon’ble Delhi High Court Mediation and Conciliation Centre, Delhi High Court, Sher Shah Road, New Delhi on 12.11.2023. Grant Such order or further order(s) as may be deemed fit and proper in the facts and circumstances of the case and to secure the ends of justice.”

Learned counsel for the petitioner submits that as per settlement the last instalment of Rs. 5 lakhs is to be paid by the respondent on 22.12.2025.

said amount will be cleared by him in two instalments. It is further submitted that the respondent shall pay first instalment of Rs. 2.5 lakhs to the petitioner on 22.12.2025 and the second instalment of Rs. 2.5 lakhs shall be paid by him on or before 15.02.2026.
