The present petition under Sections 10 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: -

“a. Issue notice to the Contemnors calling upon them to show cause as to why they should not be tried for Contempt of Court and punish the Contemnors after following the procedure established by law; b. Initiate Contempt Proceedings against the Contemnors for noncompliance of the order of this Hon'ble Court dated 07.08.2024. c. Direct the Contemnors to provide the calculation on the basis of which they have made part payment.

d. Direct the contemnors to pay the remaining outstanding amount as per the correct calculation;

d. Pass any other or further order(s) that this Hon'ble Court may deem fit in the facts and circumstances of the case and in the interests of justice.”

New Delhi has been placed on record, wherein it has been recorded as under:

“4. It is humbly submitted that in compliance of the directions of Hon' ble Court, a sum of Rs. 46,19,246/- (Rs. Forty Six Lac Nineteen Thousand Two Hundred Forty Six only) as arrears of pension was paid to the legal heirs of the deceased officer in the month of July, 2025. Now, an amount of Rs. 33,00,128/- (Rs. Thirty Three Lac One Hundred Twenty Eight Only) as interest on pension arrears has also been paid to the legal heirs (Rs. 8,25,032/each) of the deceased retired officer and the money has been credited in their accounts on 10.09.2025. The copy of PFMS transaction of above amount of Rs. 33,00,128/- is attached as Annexure 2.

It is humbly submitted that the interest on the above amount of arrear was also calculated up to 01.08.2020 and Rs. 33,00.128/were credited in the accounts of legal heirs of the Retired officer on 10.9.2025. It is further intimated that process of calculating the amount of interest for the period from 02.08.2020 to November, 2025 is underway and efforts are being made to get it sanctioned and credited to the legal heirs of the retired officer.

It is humbly submitted that the answering Respondent have utmost respect and regard for the orders passed by this Hon'ble Court. There is no intention to not abide by the same.”

In view of the above, the present petition is disposed of with the directions that the exercise regarding the calculation of interest and disbursal of the same as noted in para 5 hereinbefore shall be done within a period of 4 weeks.

In case of non-compliance, the petitioner will be at a liberty to revive the present petition.

The present petition is disposed of with the aforesaid directions.
