This is a petition filed under Section 14 and 15 of the Arbitration and Conciliation Act, 1996 seeking termination of the mandate of the learned Sole Arbitrator.

It is stated that the learned Sole Arbitrator had reserved the Award on 24.11.2023 and till date the Award has not been pronounced. Additionally, the appointment of the learned Sole Arbitrator is also hit by the judgment of “ Perkins Eastman Architects DPC & Ors. vs. HSCC (India) Ltd. ” (2020) 20 SCC 760.

Mr. Gupta, learned counsel appears on behalf of the respondent and has no objection to the petition being allowed.

For the said reasons, the mandate of the learned Sole Arbitrator stands terminated and the following direction are issued:-

i. With consent of parties, Delhi International Arbitration Centre

(DIAC) Delhi High Court, Sher Shah Road, New Delhi (hereinafter, referred to as the ‘DIAC’) will appoint an Arbitrator out of the Panel of the Advocates maintained by the DIAC.

ii. The arbitration will be held under the aegis and rules of the Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi (hereinafter, referred to as the ‘DIAC’).

iii. The remuneration of the learned Arbitrator shall be in terms of DIAC (Administrative Cost and Arbitrators’ Fees) Rules, 2018.

iv. The learned Arbitrator is requested to furnish a declaration in terms of Section 12 of the Act prior to entering into the reference.

v. It is made clear that all the rights and contentions of the parties, including as to the arbitrability of any of the claim, any other preliminary objection, as well as claims/counterclaims and merits of the dispute of either of the parties, are left open for adjudication by the learned arbitrator.

vi. The parties shall approach the learned Arbitrator within two weeks from today.

The Sole Arbitrator shall commence the proceedings from the stage of arguments.

The mandate of the Sole Arbitrator is extended by a period of 1 year form today to make and publish the Award. The period till today stands regularized.
