By way of present petition filed under Section 9 of the Arbitration & Conciliation Act, 1996 (hereinafter, referred to as the ‘A&C Act’), the petitioner seeks interim directions.

Learned counsel for the parties submits that in the Arbitration Petition being ARB.P. 60/2024, the Supreme Court has already referred the disputes to the learned Arbitral Tribunal. Considering that the Arbitral Tribunal has already been constituted, learned counsels pray that the instant petition itself be directed to be treated as an application under Section 17 of the A&C Act. It is further submitted that the petitioner be granted the liberty to urge all his contentions/reliefs before the Ld. Arbitral Tribunal.

Accordingly, the disputes having been referred to the Arbitral Tribunal so constituted, the present petition is disposed of with the direction that the petition under Section 9 of the A&C Act itself be treated as an application under Section 17 of the A&C Act.
