% 16.05.2025 1. Learned counsel for MCD has also appeared on advance notice and submits that the property in question has already been inspected and the report is being filed before learned Trial Court, today itself.

Learned counsel for petitioner submits that in view of the above, she does not press the present petition but, at the same time, she makes a request that since there is no counter-claim or counter suit in this regard, learned Trial Court may be requested to pursue with the suit filed by the plaintiff and not to give any unnecessary weightage to the bald submissions made at the Bar by the opposite counsel.

Keeping in mind the fact that the inspection has already been carried out, and in view of the aforesaid statement, the present petition is disposed of as not pressed.

However, as apprised to this Court, since there is no counter-claim or a separate suit against the plaintiff in relation to any unauthorized construction raised by them, this Court expects that the learned Civil Court would proceed further in terms of the suit filed by the plaintiff and would try to decide the abovesaid suit as expeditiously as possible.
