After hearing arguments for some time, learned counsel for petitioner, without prejudice to his rights and contentions, does not press the present petition.

He, however, submits that the tenanted premises has already been vacated in terms of the orders passed by the learned Trial Court, albeit , during the execution proceedings and the petitioner herein is also interested in amicably settlement of pending issue with respect to arrears and damages etc.

He also, very fairly, admits that the petitioner herein has neither prayed for any set off nor lodged any counter claim as such. He, however, supplements that there is every likelihood of matter, being settled amicably.

Be that as it may, in view of the above, the present petition is disposed of as not pressed.

However, at the same time, liberty is granted to the petitioner to make
