The present petition has been filed seeking interim bail in connection with FIR No.603/2019 under Sections 302/324/326/34 IPC registered at P.S. Prem Nagar, Delhi.

The learned counsel appearing on behalf of the petitioner submits that the petitioner has already been granted interim bail in connection with another FIR i.e. FIR No.170/2024 vide order dated 17.02.2025 passed in BAIL APPLN. 246/2025.

He submits that the petitioner is not in a position to avail the benefit of the said order because in the present case FIR, the petitioner has not been granted interim bail.

He further contends that on an earlier occasion also, the petitioner was granted interim bail vide order dated 18.10.2024 and the liberty so granted to him was never misused by him. Insofar as the medical condition of the

petitioner is concerned, the same has already been noted by this court in its order dated 17.02.2024 passed in BAIL APPLN. 246/2025, the relevant part of which reads as under:

“3. A perusal of the medical status report shows that the petitioner requires excisional biopsy surgery for his swelling over scalp. The petitioner is also suffering from persistent lower back pain. The relevant extract from the status report reads as under:

“At present, the aforementioned inmate/patient has been planned for excisional biopsy surgery for his swelling over scalp. Despite treatment from jail and outside referral hospitals, he is still suffering from persistent lower back pain (not subsiding on medication) and the same interfering with his routine activities. He is currently admitted in the medical intervention room for close monitoring and nursing care. He has been provided a wheelchair for his mobility until symptomatic improvement is observed, as he was complaining of struggling to walk without support.”

It is also not in controversy that earlier also an interim bail was granted to the petitioner by the learned Additional Sessions Judge vide order dated 18.10.2024 and the liberty so granted to the petitioner was never misused by him.

In view of the above, the petitioner is granted interim bail for a period of four weeks from the date of his release subject to his furnishing personal bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/ACJM/Duty JM further subject to the following conditions:

(i) The petitioner shall share his mobile numbers with the Investigating

Officer (IO) which shall be kept on at all times.

¶26

(ii) In case of change of residential address, he shall inform the Trial Court as well as the IO.

¶27

(iii) The petitioner shall not travel outside Delhi during this period.

¶28

(iv) The petitioner shall not do anything which may prejudice either the trial. The petitioner shall not directly or indirectly get in touch with any of the witnesses.

(v) In case the petitioner is found indulging in any incident or offence of tampering with evidence or approaching the witnesses, the same will become ground for cancellation of interim bail.

(vi) The petitioner shall call the IO concerned on every Saturday during the period of his interim bail.

The petitioner shall surrender immediately after the expiry of four weeks from the date of release.

Copy of this order be sent to the Jail Superintendent for information and necessary compliance.

The petition is disposed of in the aforesaid terms.
