The present petition has been filed seeking further extension of interim bail for a period of three months on medical grounds in connection with FIR No. 14/2022 under Sections 406/467/468/471/420/120B IPC registered at Police Station Special Cell.

Mr. Amit Chadha, learned senior counsel appearing on behalf of the petitioner submits that the petitioner is suffering from a serious medical condition and for the said reason he was granted interim bail for the first

time by the learned Trial Court vide order dated 31.12.2023. Subsequently, the interim bail was granted by this court vide order dated 12.07.2024 passed in BAIL APPL. No.2389/2024. The said interim bail has, thereafter, been continued.

He invites the attention of the Court to order dated 08.10.2024 passed in Bail Application No. 3647/2024 by a Co-ordinate Bench of this Court, whereby the interim bail of the petitioner was last extended for a period of three months.

He also draws attention of the Court to the discharge summary dated 28.12.2024 of the Fortis Hospital, Shalimar Bagh to contend that the petitioner was admitted in the said hospital on 24.12.2024 with the complaint of having suffered two episodes of seizure two days prior to the admission.

A perusal of the aforesaid discharge summary shows that the petitioner is a known case of Cauda Equina Syndrome (paraparesis) and has been continuously undergoing treatment for the same. The discharge summary also shows that the petitioner has been advised as follows:-

“Watch for neurological status/sensorium/seizure. - Not to drive, swim, be near fire, stand over height, these actions, if can’t be avoided should done with aid.

Attendant should watch the patient in case of seizure and assist walking to washroom and do not leave patient alone.”

In view of the above, issue notice.

Learned APP appearing on behalf of the State accepts notice. He, on instructions from the Investigating Officer who is present in Court, states that the medical documents filed along with the present petition have been

verified and the medical condition of the petitioner is not in dispute. 10. In view of the above, the interim bail of the petitioner extended by this Court vide order dated 08.10.2024 is further extended for a period of three months on the terms and conditions on which the interim bail was granted to the petitioner vide order dated 12.07.2024 passed in Bail Application No. 2389/2024.

Copy of this order be sent to the Jail Superintendent for information and necessary compliance.

Copy of this order shall also be given to the counsel for the petitioner dasti under the signatures of Court Master.

The petition is disposed of in the aforesaid terms.
