The FIR was registered on a complaint alleging that on 16.02.2019, the father of the complainant was taken away by the accused persons including the applicants herein. 5. The dead body of the complainant’s father was later found on 18.02.2019.

The applicants along with other co-accused persons were arrested on 21.02.2019. It was alleged that the accused persons were last seen with the deceased.

The co-accused, Arvvind Kumar Singh was admitted on bail by this Court by order dated 13.01.2025 noting that the applicant therein had clean antecedents and had been in custody for almost five years.

Similar role is assigned to the applicants herein and they are, therefore, entitled for grant of bail on the ground of parity. 9. The applicants are in custody since 21.02.2019 and have spent almost five years in incarceration. The applicants are also stated to be of clean antecedents. 10. In view of the above, the present applications are allowed and the applicants are directed to be released on bail on the following terms and conditions: -

a) The applicants shall furnish a personal bond in the sum of ₹ 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court;

b) The applicants shall provide their mobile numbers to the concerned IO, which shall be kept in working condition and switched on at all times. The applicants shall also provide their permanent residential addresses and in

case of change of residential address or contact details, the applicants shall promptly inform the same to the concerned IO as well as to the concerned Court;

c) The applicants shall not leave the country without permission of the concerned Court during the bail period and surrender their passport, if any, at the time of release before the concerned Court; d) The applicants shall not directly/indirectly try to get in touch with any prosecution witnesses or tamper with the evidence.

In the event of there being any FIR/DD entry / complaint lodged against the applicants, it would be open to the State to seek redressal by filing an application seeking cancellation of bail.

It is clarified that any observations made in the present order are for the purpose of deciding the present bail applications and should not influence the outcome of the trial and also not be taken as an expression of opinion on the merits of the case.

The bail applications are allowed in the aforementioned terms.

A copy of this order be placed in both the matters.
