The present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) read with Section 528 of the BNSS on behalf of the Applicant praying for regular bail in FIR No. 375/2006 registered at Police Station Defence Colony under Section 376 of the Indian Penal Code, 1860 (IPC).

1.1 Learned APP states that the Petitioner was declared a Proclaimed offender and was arrested in 2021.

1.2 He states that the charges against the Petitioner were framed on 08.07.2022. He states that thereafter, the testimony of at least five (5) to six (6) witnesses have been examined and the prosecutrix has been examined as ‘PW-1’ and she has supported the case of the prosecution.

1.3 He states that six (6) to seven (7) witnesses remains to be examined

After some arguments, learned counsel for the Petitioner seeks liberty to withdraw this petition and approach this Court after a reasonable time in case the trial is not completed in reasonable time.

Accordingly, the present petition is dismissed as withdrawn with liberty reserved.
