By way of the present application, the applicant is seeking grant of anticipatory bail in case arising out of FIR bearing no. 120/2025, registered at Police Station Jyoti Nagar, Delhi, for the commission of offence punishable under Sections 109(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereafter ‘BNS’ ).

Issue notice. Mr. Naresh Kumar Chahar, the learned APP accepts notice on behalf of the State.

Briefly stated, the facts of the present case are that on 03.03.2025, an incident of firing had taken place, wherein both accused and the complainant had sustained injuries. On 04.03.2025, the FIR was registered on the complainant of the complainant Abhishek.

the applicant has been falsely implicated in the present case. It is argued that the applicant is in judicial custody since 05.03.2025. It is further stated that the chargesheet in this case has been filed and the investigation qua the present applicant has been complete and the applicant is not required for the purpose of custodial interrogation. It is argued that the weapon allegedly used in the commission of offence has not been recovered at the instance of the present applicant. It is, therefore, prayed that the applicant be released on regular bail.

The learned APP for the State, on the other hand, argues that the chargesheet in this case stands filed, and that the present accused along with the other co-accused persons has committed the offence in question. It is argued that the weapon of offence has been recovered at the instance of coaccused Ankit @ Monty@ Kala. Therefore, it is prayed that the application for grant of regular bail be rejected.

This Court has heard arguments addressed on behalf of the applicant as well as the State, and has perused the material available on record. 7. In the present case, the record clearly reveals that five persons had received gunshot injuries, including the present accused/applicant Vashu. The investigation is complete and the applicant has remained in judicial custody for more than seven months.

Considering the overall facts and circumstances of the case, this Court is inclined to grant regular bail to the applicant herein, on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge concerned on the following terms and conditions:

permission of the concerned Court and if the applicant has a passport, he shall surrender the same to the concerned trial court. ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court and IO/SHO concerned.

iii) The applicant shall appear regularly before the learned Trial Court, unless exempted.

iv) The applicant shall not communicate with, or come into contact with the complainant or any of the prosecution witnesses, or tamper with the evidence of the case.

Accordingly, the present bail application stands allowed and is disposed of.

It is, however, clarified that nothing expressed hereinabove shall tantamount to an expression of opinion on merits of the case. 11. The order be uploaded on the website forthwith.
