It is stated that the applicant’s wife was admitted in a Hospital in Udham Singh Nagar (Uttarakhand) on 19.07.2025 and was diagnosed with severe jaundice accompanied by fever, acute viral hepatitis and generalised weakness. Thereafter, the applicant had moved an interim bail application before the learned Trial Court, but the same was dismissed on the grounds that the applicant had other family members who could care for his wife and no emergent surgery or other procedure which needed to be conducted. Eventually, the applicant’s wife was discharged from the Hospital on 03.08.2025 after her condition had been stabilised.

The learned counsel for the applicant has placed on record certain documents and has contended that the medical condition of applicant’s wife is again deteriorating and that the applicant herein wants to make financial arrangement for his wife, etc.

This Court, however, notes that the status report filed before the Trial Court reveals that the applicant’s family members i.e. two brothers - Dharmender Singh and Kuldeep Singh, two sisters-in-law - Raj Kaur and Jasbir Kaur, two sisters - Harbans Kaur and Binder Kaur and brother-in-law - Tara Singh, who are also residing in the same village, are assisting his wife. As of now, the applicant has not placed on record any medical document or opinion which would point out that the applicant’s wife has to undergo any serious medical procedure or surgery as part of her medical treatment.
