This is an application for grant of anticipatory bail filed in case FIR no. 48/2025 under Sections 318(4)/308(3)/351(4), PS Cyber Police Station, Shahdara.

The Ld. Counsel for the petitioners submits that petitioner has been roped in falsely in the present case. He is only a labourer. The role ascribed to the petitioner is that the co-accused Mangal Singh had opened a bank account mentioning the address of the petitioner. He states that such bank account was opened by the co-accused without knowledge of the petitioner. He further states that petitioner is ready to join the investigation and may be granted anticipatory bail.

The application has been opposed by the Ld. APP submitting that extortion money was received in the account of co-accused Mangal Singh and on interrogation of Mangal Singh it transpired that petitioner provided him his KYC details for the purpose of opening bank account for receiving the money of such extortion.

He states that petitioner is required for the purpose of custodial investigation and therefore, his anticipatory bail application may not be accepted.

As per allegations in the status report fraudsters contacted the complainant initially on “Quack Quack App” , then via whatsapp video call played a pre-recorded obscene video featuring a women. The complainant was instigated into getting nude and subsequently his video was recorded. The complainant later received the obscene video of himself recorded by the fraudsters and in lieu of deleting the obscene video, money was demanded. Being scared, the complainant transferred Rs. 35,000/- in the provided bank account. Later on when money was again demanded he lodged the complaint at NCRP portal whereupon the present case was registered.

The investigation reveals that the cheated amount of Rs.35,000/- was transferred in a bank account in the name of one Mangal Singh which contained a registered mail ID. On verification of the mail ID from Google, it was found that the aforesaid mail ID was generated from the mobile number in the name of co-accused Shyam Singh.

As per the status report, Shyam Singh is relative of the present petitioner Pratap Singh and he was arrested from the house of the petitioner. Mobile phone was recovered from his possession. Upon interrogation he disclosed that he called his accomplice Mangal Singh at the house of the

present petitioner and got opened bank account of Mangal Singh at his house.

During interrogation co-accused Mangal Singh disclosed that several other bank accounts was also got opened at the address of the petitioner and illegal activities were in the full knowledge of the applicant and these bank accounts were used to siphon of the cheated money.

Even though the chargesheet of the case has been submitted against the co-accused, the petitioner is stated to be required for the purpose of custodial interrogation for unearthing the entire conspiracy. 11. Keeping in view the nature and gravity of allegations as also the fact that the applicant is required for the purpose of custodial interrogation, the Court is of the view that this is not a case for grant of pre-arrest bail. 12. The application is therefore, dismissed.
