This is an application, filed by the applicant-Amritpal Singh for grant of interim bail for a period of sixty days in case registered at National Investigation Agency, New Delhi under Sections 21(c), 23(c) and 29 of NDPS Act, 1985.

It has been submitted by learned counsel appearing on behalf of applicant that wife of the applicant is suffering from gall bladder cholelithiasis and has been referred for surgery by Doctor at New Life Hospital.

It is submitted that applicant is the father of two minor children and besides them and his aged mother, there is nobody to attend to his wife at the time of surgery.

for more than one year. Investigation is complete and charge sheet has already been filed. He is, therefore, not required during the interim period of treatment of his wife.

It is further submitted that conduct of the applicant has been satisfactory and he has no intention to flee from justice. He never tried to abscond. He himself joined the investigation, at least four times. He is ready to abide by any condition of bail, as imposed by this Court.

The application has been vehemently opposed by the learned SPP appearing for the respondent. She submits that initially, medical treatment of wife of the applicant was taken from a private hospital, namely, New Life Hospital located near residential house of the applicant. RespondentNational Investigation Agency [“ NIA ”] has taken the opinion of Doctor at New Life Hospital regarding the health condition, nature, treatment and severity of the medical condition of the wife of the applicant and as per the opinion of Doctor, there is no emergency in surgery and cholelithiasis surgery case falls under the category of, “elective surgery”.

She further states that applicant has now cleverly taken the opinion of Doctor at Amritsar Golden Hospital, Amritsar, which is far away from the house of the applicant but again as per the Doctor’s opinion there, it is an elective procedure and the patient is usually discharged within 24 hours of surgery and does not require extensive or intensive care.

It has been further submitted that applicant had earlier filed interim bail application for a period of seven days on account of death of his brother-in-law in an accident. He filed second application for interim bail on the ground of admission of his son in a private school in Tarn Taran, Punjab. It is argued that since the applicant could not get relief of release on bail,

this is a third attempt to get the relief of release on interim bail. It is argued that applicant is at flight risk, he is an immigration tour operator and was detained while trying to flee from India.

It is also submitted that there are other family members of the applicant, who can take care of applicant’s wife at the time of surgery. The allegations against the applicant being of very serious nature and considering the above, he may not be released on interim bail.

As per the prescription of Doctor at Amritsar Golden Hospital, it is an elective procedure and does not require extensive or intensive care. The wife of the applicant is a professor in a college. Thus, she is educated and financially independent woman and the report received from Senior Superintendent Police, Tarn Taran, Punjab, furnishes the details of family members of the applicant who can attend her at the time of surgery.

Keeping in view the aforesaid facts and circumstances, I do not find any compelling reasons for the grant of interim bail to the applicant. However, he would be at liberty to seek custody parole from the trial Court in case he so desires.

The application for interim bail is, accordingly, dismissed.
