The petition before this Court is seeking anticipatory bail in relation to FIR No. 142/2021 dated 28.07.2021 under Section 419/420/120B, registered at Police Station Crime Branch.

Matter was earlier heard by the Co-ordinate Bench of this Court and the petitioner was granted interim protection vide order dated 26.05.2025 in the following terms:

“3. The present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks anticipatory bail in case FIR No.142/2021 under Sections 419/420/120B of the IPC, registered at P.S. Crime Branch. 4. Learned counsel appearing on behalf of the applicant submits that pursuant to the order dated 24.04.2025, during the pendency of the latter’s anticipatory bail application before the learned ASJ, he was granted interim protection and had joined the investigation. It is submitted that,

thereafter, he has given a statement to the Investigating Officer and has cooperated with the investigation.

5. Learned APP, on instructions of the Investigating Officer, submits that the applicant has joined the investigation and he has given some information, for which the investigation is ongoing.

6. Issue notice.

7. Learned APP for the State accepts notice and seeks some time to file a status report. Let the same be filed before the next date of hearing, with an advance copy to learned counsel for the applicant.

8. List on 19.08.2025.

9. On the applicant joining the investigation as and when directed by the concerned Investigating Officer, no coercive steps shall be taken against the applicant till the next date of hearing.

10. Order be uploaded on the website of this Court forthwith.”

On resumed hearing today, on a query put to the learned APP for State, she would submit under instructions of the IO, who is present in Court, that investigation is complete and the charge sheet is almost final and that the same shall be filed within a month before the competent Court.

In view thereof, it transpires that since the charge sheet has been prepared and the investigation is complete, the petitioner is not required for any custodial investigation.

In the premise, the interim protection granted to the petitioner is made absolute subject to compliance of the conditions contained under Section 482 (2) of the BNSS. The Investigating Officer, who is present in Court, shall formally arrest the petitioner and release him forthwith subject to his furnishing personal bond with one surety of equivalent amount in compliance of the provisions of Section 482(2) of the BNSS.
