Amardeep Singh Vs State NCT of Delhi

This is a petition filed under Section 439 of the Code of Criminal Procedure, 1973 seeking grant of interim bail to the petitioner for a period of 6 weeks in FIR No. 1653/2015, dated 03.11.2015, registered at Police Station Vasant Vihar under sections 420/34 of IPC, 1860 on the ground that the petitioner is having severe bleeding from rectum due to the piles.

On 15.01.2025, the medical report of the petitioner was called from the concerned Jail Authorities.

The medical report of the petitioner has been handed over in court today and the operative portion reads as under:

“In view of order by Hon'ble court of Ld. JMFC-05, Saket Courts on 05.10.2024, inmate patient was sent to DDU Hospital for detailed medical examination on 06.10.2024 for

his complaint of Bleeding PR on and off for past 06 months. As per medical examination done in Surgery department the findings

are-

1. Grade II internal Hemorrhoids at 7 o'clock position.

2. Grade III-IV External Hemorrhoids

3. No active bleeding or clots were noted.

During examination other relevant findings were Fecal loading was found and PC enema was given and patient passed stool. After informed consent proctoscopy test was done and finding suggestive of grade 2 internal hemorrhoids with grade 3-4 external hemorrhoids. Accordingly Inmate Patient was advised conservative management and high fiber diet and plenty of oral fluids. He was prescribed oral medications as well as topical ointment and sitz bath and also to review in surgery OPD regularly.

Thereafter on 19.10.2024, 22.10.2024 and 05.11.2024 inmate patient was again sent to DDU Hospital for Surgery follow-up for his surgical issue wherein he was administered injection Sclerotherapy with 5% phenol as a primary measure to control bleeding per rectally.

Even after receiving injection Sclerotherapy on 05.11.2024, inmate patient has presented at jail dispensary few times with still persistent complaint of Bleeding on & off for which he was referred to DDU Hospital again on 07.12.2024, 09.12.2024 and RML Hospital on 12.12.2024 wherein in view

of his above mentioned latest complaint he was examined afresh, anal tag at 4,7,10 O'clock position was noticed with bleeding, prescribed conservative treatment and advised for fresh proctoscopy after a week or so on subsidence of pain. Latest on 15.01.2025 inmate patient was again sent to RML Hospital for. surgery follow-up wherein he provided complaint of Pain in Perianal region with bleeding P.R, examined thoroughly, on per rectal examination findings were decreased tone with circumferential skin tag with Hemorrhoids and advised conservative treatment and dietary modification.

It is further submitted that as per medical literature in cases of non- desirable result of injection Sclerotherapy as supposed to be his case based on his presenting complaints and vital status, now patient is a potential candidate to be considered for Hemorrhoidectomy Surgery on surgeon's advice.

At last it is submitted that in recent past inmate patient has reported at jail dispensary few times with complaint of bleeding P.R, severe pain while defecation with dizziness and weakness and history of 2-3 episodes of fainting during last 1 month or so for which he was admitted in M.I Room jail dispensary to ensure close observation of his vitals and administration of symptomatic treatment in the wake of persisting symptomatology.”

A perusal of the medical status report shows that the petitioner has a case of severe rectum bleeding and in this regard, the petitioner has earlier been sent for surgery, however, the same could not be performed. Further, it

is also noted that the petitioner is to have a high fibre diet, plenty of oral fluids.

Additionally, he is also advised to take proper oral medications along with topical ointment and sitz bath.

The petitioner has also complained about severe pain during defecation, accompanied by dizziness, weakness, and 2-3 episodes of fainting.

I am of the view that the petitioner needs urgent medical attention which cannot be provided from the jail.

For the said reasons, the petition is allowed and the petitioner is directed to be released on interim bail for a period of 6 weeks in FIR No. 1653/2015 dated 03.11.2015, registered at Police Station Vasant Vihar under sections 420/34 of IPC, 1860 subject to the following terms and conditions:

(a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Jail Superintendent;

(b) The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. The petitioner shall also provide his permanent residential address and in case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned IO as well as to the concerned Court;

(c) The petitioner shall not leave the country without permission of the competent Court during the bail period and surrender his passport, if any, at the time of release before the concerned

(d) The petitioner shall not tamper with the evidence.

(e) The appellant shall surrender before the Superintendent Jail after the expiry of interim bail period
