This is an application filed on behalf of applicant in case FIR No. 1048/2024 registered under Sections 179/180/61(2)(a) of BNS, 2023 at Police Station Narela, Industrial Area.

Learned counsel appearing for the petitioner submits that applicant is an innocent person having been falsely implicated in the present case. It is stated that applicant has been arrested only upon the disclosure statement made by the co-accused and recovery of counterfeit currency notes has been planted upon him. It is also submitted that investigation is complete and charge sheet has already been filed and, therefore, applicant is not required for the purpose of any investigation. It is stated that applicant is not at flight risk and has deep roots in the society and is in custody since 15.11.2024.

The bail application has been opposed by the learned APP, arguing that 40 counterfeit notes in the denomination of Rs. 500/- each have been recovered from the present applicant. The allegations made are grave and serious in nature and the punishment provided is severe. The applicant is a resident of Uttar Pradesh and is a flight risk, and therefore, he is not entitled for the grant of bail.

As per the prosecution case, based on the secret information, coaccused Vikas Bhardwaj was apprehended by the Police and 399 counterfeit Indian currency notes of Rs. 500/- each were recovered from his possession. Upon interrogation, it was disclosed that he used to procure fake Indian currency notes from one, Raju and Ganesh and further distribute them to the other members of the syndicate. A trap was, therefore laid and in the said trap, co-accused Sachin was apprehended. Sachin has further disclosed that he had previously obtained Rs. 50,000/- of counterfeit currency of Rs.500/notes each from Vikas and his associate Satyam and that FICNs worth Rs. 20,000/- were still in their possession.

Again a trap was laid and on 15.11.2024. applicant Satyam and Sachin came together to obtain FICNs, when Sachin came to collect more counterfeit notes from Vikas, he handed over the remaining FICNs to Satyam, who was stationed on the Foot Over bridge to keep watch. As Sachin approached Vikas to collect the fake notes, Police apprehended him and seeing this, Satyam fled from the spot. Later on, Satyam was apprehended from the hotel on the information given by the Sachin. 6. During interrogation, applicant had disclosed that upon seeing the Police, he had thrown the remaining counterfeit notes under the Foot Over bridge. recovered from the open ground beneath Badli Metro Station, Foot Over bridge.

Admittedly, recovery has already been effected at the instance of the present applicant, who is stated to be in custody since 15.11.2024. The investigation is complete and charge sheet has already been filed in the case. Charges are yet not settled, and therefore, trial may not conclude in the near future.

Keeping in view the aforesaid, applicant/Satyam Singh is admitted on bail on his furnishing a personal bond in the sum of Rs. 20,000/- with surety of the like amount to the satisfaction of trial Court/Duty Magistrate, subject to the conditions that applicant shall not tamper with the evidence and shall appear regularly before the Court, as and when directed.
