% 01.09.2025 1. The present application is filed seeking pre-arrest bail in FIR No. 174/2024 dated 29.02.2024 for offences under Sections 21/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Narela.

The FIR was registered way back on 29.02.2024 pursuant to the recovery of 300 grams of heroin from the possession of the accused persons. Names of multiple persons surfaced during the course of investigation in regard to the supply of contraband.

One of the accused, namely, Sahida, whose name occurred during the course of investigation, stated that she had procured the contraband from the applicant many times. The statement was recorded on 02.03.2024.

It is pointed out that since then, the applicant has been absconding which also led to issuance of Non-Bailable Warrants by the concerned Court on 23.12.2024 and the proceedings under

Section 84 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘ BNSS ’) were also initiated against the applicant in the month of January, 2025.

The learned counsel for the applicant though states that that applicant has been falsely implicated in the present case, at this stage, considering the conduct of the applicant who is absconding from the last more than one year and that the proceedings have been initiated against him under Section 84 of the BNSS, this Court does not consider it apposite to grant any extraordinary relief in the nature of pre-arrest bail to the applicant.

It is also pointed out that, apart from the present case, the applicant has been involved in multiple cases ranging from the offences under Section 302 of the Indian Penal Code, 1860 (‘ IPC ’), Section 307 of the IPC, Section 397 of the IPC and Arms Act as well.

The antecedents of the applicant also do not entitle him of any relief.

The present bail application is, therefore, dismissed.
