M/S Tewatia Construction Pvt. Ltd. Vs Public Works Department Govt of NCT of Delhi

This is an application under Section 11(6) of the Arbitration & Conciliation Act, 1996 for appointment of an Arbitrator to adjudicate the disputes which have arisen between the parties.

It is stated that the Petitioner was awarded the contract by the Respondent for the execution of the work of additional SPS classrooms in various schools under Priority-II. SH: C/o 192 nos. SPS type classrooms, libraries, toilets, labs & 2 Nos. M.P. Hall etc. including internal & external water supply, sanitary installation, electrical installation, firefighting system and development of site etc. under Education M. Division (West) at SBV No.1 Tilak Nagar, SBV No.2 Tilak Nagar, GGSSS No.1 Tilak Nagar, SKV No.3 Tilak Nagar & SBV Block-A Vikaspuri New Delhi [Package-J].

It is stated that a completion certificate was issued by the Respondent on 28.02.2022. It is stated that since there were certain outstanding dues pending by the Respondent, the Petitioner issued them a notice dated

10.06.2024 under Section 21 of the Arbitration & Conciliation Act in terms of Clause 25 of the GCC.

It is stated that since the Respondent did not reply to the said notice, the Petitioner has approached this Court by filing the instant petition for appointment of an Arbitrator.

During the course of hearing, respective Counsel for the parties jointly request that an independent Sole Arbitrator be appointed to adjudicate the disputes between the parties.

Accordingly, Mr. Vinod Kumar Malik, SDG (Retd.), CPWD, (Mob: 9818232555) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The fees of the learned Sole Arbitrator shall be fixed as per the Fourth Schedule of the Arbitration & Conciliation Act, 1996.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act, 1996 within two weeks of entering into reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression of this Court on the merits of the contentions of the parties.

The petition is disposed of along with pending application(s), if any.
