The present petition has been filed seeking following relief:

“a. Issue an appropriate writ, order or direction in the nature of Mandamus, directing Respondent No. 3 (the concerned bank) to forthwith release the amounts of ₹34,000/- and ₹14,000/-, which have been marked as "shadow amounts" against Ticket Nos. 207032962 and

b. Issue an appropriate writ, order or direction in the nature of Mandamus, directing Respondent No. 3 to make the Petitioner’s bank account bearing Account No. 36931540703 fully operational and functional without any further delay;

c. Issue appropriate writ/order/directions in the nature of mandamus and direct the Respondents to pay the cost of this petition to the petitioner”

At the outset, Mr. Ashu Bidhuri, learned counsel appearing on behalf of the respondent no.2/RBI submits that before filing the present petition the petitioner had made a complaint to the RBI Ombudsman vide complaint number N202324023638995, however, said complaint was closed on the ground that certain documents which were sought by the Ombudsman were not furnished by the petitioner.

He submits that the said compliant may be revived and liberty may be granted to the petitioner to furnish the relevant documents with further directions to the RBI Ombudsman to dispose of the complaint in a time bound manner.

On the other hand, Mr. Dhaval Mehrotra, learned counsel for the respondent no.2/RBI submits that the petitioner is at liberty to file fresh complaint before the RBI/Ombudsman.

Having regard to the limited prayer articulated and further considering that the complaint of the petitioner has been closed without adverting to the merits, present petition is disposed of with a direction that the Closure Intimation dated 11.03.2024 with respect to complaint number N202324023638995 of the petitioner filed with the RBI Ombudsman is set

aside and the said complaint of the petitioner is restored to its original number.

Let petitioner furnish relevant documents to the RBI Ombudsman within a period of two weeks from today.

The RBI Ombudsman is also directed to expedite the disposal of the complaint, preferably within a period of eight weeks from today.

Needless to say that, if the grievance of the petitioner survives even after passing of an order by the RBI Ombudsman, he shall be at liberty to approach the Court.
