On 29.04.2025, following order was passed:

“1. Mr. Bajrang Vats, learned counsel for the petitioner, states that the University Grants Commission [“UGC”], by a communication dated 03.05.2024, addressed to the Union of India, Ministry of Education has recommended as follows:

“ 2. The matter was placed before the UGC Standing Committee and the Committee examined the matter afresh and recommended that the Library Attendants (appointed before 08.04.1998) be considered for award of first financial upgradation in the pay scale of Rs.4500-7000 as decided by the Executive Council of the University of Delhi at its meeting held on 14.01.1993. This would settle the case once for all as it would also avoid recovery from the said employees. Such a

decision will also be in conformity to the order passed by the Hon’ble Supreme Court of India in the matter of Rafiq Masih and ors. regarding recovery. As informed by the University of Delhi, the total financial implication to be incurred for the award of the scale of pay of Rs.4500- 7000 (pre-revised 5th CPC) is approximately Rs.27 Lakhs for which no additional funds are required from the Govt. of India and will be met out within the allocated funds.

3. The above recommendation of the Committee was placed before the Commission in its meeting held on 16th April 2024. The Commission approved the recommendations of the Standing Committee.

4. Keeping in view the recommendation of the Standing Committee the matter is referred to MoE for their concurrence so that the decision of the Commission can be conveyed to University of Delhi. ”

A copy of the said communication is handed up to the Court, and is taken on record.

Mr. Vats states that the petitioners would be satisfied if this recommendation is implemented.

Mr. Ravinder Agarwal, learned counsel for UGC, states that according to his instructions, the matter remains pending with the Union of India.

On the oral request of Mr. Vats, Union of India through the Secretary, Department of Higher Education, Ministry of Education is impleaded as respondent No. 4. Amended memo of parties be filed within two days.

Mr. Arnav Kumar, learned Standing Counsel for Union of India, is present in Court, and is requested to take instructions as to the status of UGC‟s recommendation letter

dated 03.05.2024. Copies of the communication handed up to the Court today have also been handed over to Mr. Kumar.

In the meanwhile, the petitioners are directed to place the subsequent developments on record by way of an affidavit within one week. The respondents are directed to respond to the petitioners‟ additional affidavit within two weeks thereafter.

Learned counsel for the Union of India submits that the file has been approved by the Ministry concerned.

Learned counsel for the petitioner, in view of the subsequent development is not pressing this petition with liberty to approach the respondents for the consequential benefits.

The petition is disposed of as not pressed with liberty as prayed for.

¶32

There is no doubt that respondent no. 1 shall act expeditiously, preferably within two months to implement the decision taken by the Ministry concerned.
