This is a petition of 2011 vintage.

A perusal of the Order Sheet of 20.01.2025 would make it evident that the learned counsel for the Petitioner has only been “intermittently appearing in the matter.”

In the said Order, this Court was also forced to note that it appeared that the Petitioner was not interested in pursuing the matter.

When the matter was taken up in the first call today, a request for adjournment was made by the learned proxy counsel for the Petitioner on the ground that the diary of the learned counsel for the Petitioner was extremely full today and that he was on his legs before the Learned National Consumer Disputes Resolution Commission [“ NCDRC ”] and Dwarka District Courts. The matter was passed over with a request for the counsel on record to be present.

proxy counsel who appeared in the first call, made a statement that he had made a mistake and that the learned counsel for the Petitioner was present in the High Court but was called away to the learned NCDRC for a time fixed matter.

Upon repeated queries as to the time at which the said matter before the learned NCDRC was fixed, the learned proxy counsel for the Petitioner was unable to give any answer.

Under such circumstances, it was directed that the matter be taken up at 04:30 pm for the learned counsel for the Petitioner to appear before this Court.

It is now 04:40 pm. None has appeared on behalf of the Petitioner.

Under the circumstances, the petition is dismissed for nonprosecution.
