The petitioner has filed the present petition, inter alia, praying as under: -

“a) To direct the respondent no.1 to do the audit of the accounts of the respondent no.2.”

The petitioner claims that she and her husband became members of respondent No.2/society (The Shivam Co-Operative (U) Thrift Credit Society Limited) on 20.07.2008. She states that she and her husband have deposited ₹62,55,140/- in a fixed deposit (FD) with the respondent society in the name of their grandson and grand-daughter for different periods. According to the petitioner the value of the said FDs had increased to ₹78,04,150/- as on their respective due dates on the basis of accumulation of interest at the rate of 11.5 per cent per annum. She states that she and her husband (since deceased) approached respondent no.2 for liquidating the fixed deposits but their request was in vain. She states that she has been pursuing respondent no.2/society since but the amounts due to her have not been released. She also alleges that her husband was put under severe stress of the prospect of losing his hard-earned savings, which resulted in his

In the aforesaid backdrop the petitioner’ husband has lodged an FIR at Laxmi Nagar Police Station, under Section 420/406 of the Indian Penal Code, 1860 which is currently under investigation since 13.07.2021. The petitioner further states that she also filed a complaint under Section 60 of the Delhi Co-operative Societies Act, 2003 on 10.01.2025 for auditing the accounts of respondent society.

The learned counsel appearing for respondent no.1, appearing on advance notice, submits that an administrator appointed has resigned. Certain members of the respondent society have demanded that respondent no.2 be liquidated, however, a liquidator has not been appointed as yet. She states that the request for liquidation is being examined. She also states that the complaint made by the petitioner would be examined.

In any event, it is necessary that the proper accounts of the respondent no.2 society be drawn up and same would also require to be audited. 6. In view of the above, we consider it apposite to dispose of the present petition, by directing respondent no.1 to take necessary steps in accordance with law and to ensure that the accounts of respondent no.2 society are drawn up and audited, if already not done.

The petition is disposed of in the above terms. Pending application is also disposed of.
