Responding to the present writ petition, learned counsel appearing for respondent no. 1-MCD, submits that the construction in the property is being carried out pursuant to the Sanctioned Building Plan.

He submits that the property has been inspected and no unauthorized construction has been found therein and the construction is being undertaken in consonance with the Sanctioned Building Plan.

At this stage, learned counsel appearing for the petitioner submits that he wishes to withdraw the present writ petition, with liberty to seek remedies in accordance with law, in case any cause of action arises in future. 5. Accordingly, the present writ petition, along with the pending application, is dismissed as withdrawn, with the aforesaid liberty.
