By way of present petition, the petitioner seeks quashing of the Demand Notice dated 30.10.2018 issued by respondent No.1.

While assailing the aforesaid demand notice, learned counsel for the petitioner submits that there is a dispute as to whether the parking site is owned by respondent No.1 or DDA and in this respect, cites the order dated 17.08.2023 passed in W.P.(C) 9090/2018. He further submits that the petitioner was never able to use the entire parking site and in this regard, made various representations for consideration of the petitioner’s case for reduction in the monthly licence fee. Insofar as prayer (b) is concerned, it is informed that the contract has already elapsed in the year 2019 and the relief has, thus, become infructuous.

Ms.Kalra, learned Standing Counsel for respondent No.1, on instructions, submits that in view thereof, the petitioner’s aforesaid request would be considered in accordance with law and disposed of within a period of six weeks.

Considering the aforesaid, the present petition is disposed of with a direction that the present petition itself be considered as the petitioner’s representation by respondent No.1 and that the petitioner be granted an opportunity of hearing after due notice and the matter be disposed of within the aforesaid period of six weeks.

It is made clear that till the representation is disposed of, the aforesaid demand notice shall remain stayed.

Needless to state that in case the petitioner remains aggrieved, he shall be at liberty to approach the Court again, in accordance with law.
