Learned counsels for Petitioner No. 1 and Respondent No. 2 have handed over the copy of the compromise-cum-settlement deed dated 07.05.2024 executed between the parties in an out of Court settlement.

Learned counsel for Petitioner No. 1 and Respondent No. 2 states that as per the said settlement, one of the obligations undertaken by the Petitioner No. 1 is to withdraw the present petition.

Learned counsel for the Petitioner No. 1 states that Petitioner No. 2 is the daughter of Petitioner No. 1 and she as well has no objection to the withdrawal of the said petition.

3.1. He states that he will file his vakalatnama on behalf of Petitioner No. 2 within one (1) week from today.

3.2. He states that as per clause ‘W’ of the agreement, the Respondent No.

3.3. He states that he, however, reserves his rights to revive the present petition in the event, the Respondent No. 2 does not cooperate in quashing of the said proceedings.

Learned counsel for the Respondent No. 2 has no objection to this submission of the Petitioner No. 1.

Learned counsel for Petitioner No. 1 further states that under the Will dated 03.12.2012, which is the subject matter of the present petition, Petitioner No. 2 herein was entitled to receive one jewellery set. He states that in view of the settlement, Petitioner No. 1 herein undertakes to provide equivalent of the said jewellery set to Petitioner No. 2 and therefore, there is no impediment in the disposal of these proceedings.

In view of the aforesaid consent of the parties, the present petition is dismissed as withdrawn reserving liberty to Petitioner No. 1 to revive this petition in the event clause ‘W’ of the settlement deed dated 07.05.2024 is not complied with by Respondent No. 2.

Pending applications also stand disposed of.

Learned counsel for Respondent No. 2 is directed to place this agreement on record.
