By way of the present petition filed under section 29A (4) of Arbitration & Conciliation Act 1996, the petitioners seek extension of mandate of the learned Sole Arbitrator who is seized of their disputes with the respondents.

Mr. Zafar Khurshid, learned counsel appearing for the petitioners submits, that the Arbitrator was appointed vide order dated 25.01.2021 in ARB.P. No. 769/2020; and the mandate of the learned Sole Arbitrator was thereafter extended by mutual consent of parties upto 07.01.2024.

The record shows that the mandate has been further extended by a Coordinate Bench of this court vide order dated 22.12.2023 till 07.06.2024.

Mr. Khurshid submits, that as recorded in order dated 03.05.2024, the matter is now at the stage of cross-examination of RW-2; and there are two other official witnesses who are to be examined; and thereafter the parties would proceed to final arguments.

Vide order dated 03.05.2024 the learned Arbitrator has informed the parties that they should take appropriate steps for seeking extension of his mandate.

Issue notice.

Mr. Ujjwal Malhotra, learned counsel appears on behalf of respondents Nos. 1 & 4 on advance copy; accepts notice; and does not oppose the prayer made.

For the record, respondents Nos. 2 & 3 have already been set ex-parte in the arbitral proceedings; and it is therefore not considered necessary to issue notice to the said respondents.

Upon a conspectus of the averments contained in the petition and the submissions made, the petition is allowed; and the mandate of the learned Arbitral Tribunal is extended, as prayed-for, by a period of 09 months with effect from 08.06.2024, with a request to the learned Arbitrator to conclude the proceedings within that time.

The petition stands disposed-of in the above terms.

Pending applications, if any, also stand disposed-of.
