Learned counsel for the Petitioner and Respondent No. 5 state that the matter has been settled between the parties vide agreement dated 04.09.2025 executed before the Delhi High Court Mediation and Conciliation Centre.

The settlement agreement has been placed on record.

In terms of the settlement agreement, as per Clause 4, the Petitioner has agreed to drop Respondent Nos. 1 to 4 from the array of parties. Accordingly, Respondent No. 1 to 4 are hereby deleted from the array of parties.

Petitioner shall file an amended memo parties within two weeks.

This Court has heard the learned counsel for the plaintiff and the defendants and perused the Settlement Agreement dated 04.09.2025.

The Supreme Court in Afcons Infrastructure Ltd. v. Cherian Varkey Construction Co. (P) Ltd.¹ , while dealing with Section 89 of the CPC has observed that the settlement agreement will have to be placed before the Court for recording it and for disposing of the petition in terms of the settlement. It held that the Court should apply the principles of Order XXIII Rule 3 CPC and pass orders of disposal so as to make such settlement effective.

This Court is satisfied that the compromise between the parties as contained in the aforesaid Settlement agreement dated 04.09.2025 satisfies the requirements of Order XXXIII Rule 3 CPC and is lawful.

The statements and undertaking given by Petitioner and Respondent No. 5 are accepted by this Court and the parties are held bound by the same. Accordingly, the petition is disposed of in terms of the said settlement. All future dates stand cancelled.
