Plaintiff has filed the present suit for infringement of their copyright in the software programs “NUKE” and “NUKE X” as well as its various versions. During the course of the proceedings, the parties have executed a Settlement Agreement dated 29^th April, 2024, before the Delhi High Court Mediation and Conciliation Centre, accompanied with a Power of Attorney in favour of authorised representative of Plaintiff, and a Board Resolution in favour of authorised representative of Defendant No. 1.

In terms of the Settlement Agreement, Defendant No. 1 has already purchased two licenses of the software in question, in terms of Clause 2(i) of the Settlement Agreement, and have further agreed to purchase two additional licenses within a period of six months, in terms of Clause 2(ii) of the Settlement Agreement.

Accordingly, the present suit is decreed in favour of the Plaintiff and against the Defendants, in terms of the Settlement Agreement dated 29^th April, 2024, which shall form part of the decree. Needless to say, the parties shall remain bound by the terms and conditions of the settlement.

In view of the above, since the parties have arrived at a compromise, the Registry is directed to issue a certificate for refund of full Court fees, in favour of Plaintiff.
